On April 30, 2025, a groundbreaking consent order was entered in the class action lawsuit against the New Jersey State Police (NJSP) over the long-standing backlog in expungement processing. This order finally creates something New Jersey has never had before: a way to formally request expedited processing of an expungement order once it’s been granted by the court.

Under the April 30, 2025 consent order, the NJSP now commits to:

  • Processing expungement orders within 120 days of receiving them,

⏳ What’s the Difference Between Court Processing and NJSP Processing?

There are two key parts to every New Jersey expungement:

1. Court Processing (Not Covered by the Consent Order)

This is when your case is filed, reviewed, and granted by the court. The judge signs the expungement order. This process varies significantly by county and judge, and unfortunately, the April 2025 order does not apply to this step.

At NSLF, we still file motions to expedite court processing when appropriate—but this is discretionary, and not guaranteed.

2. NJSP Processing (Covered by the Consent Order)

This is where the NJSP updates your state and FBI criminal record (computerized criminal history or “CCH”) after the court grants the expungement. This is the part of the process that now has formal deadlines—and the new option to request expedited handling under exceptional circumstances.

The court must find “exceptional circumstances” to shorten the NJSP’s timeline. That means we must clearly explain why your situation deserves special treatment.
