When Can the BCMR Award Backpay?
The Board for Correction of Military Records (BCMR) has authority to restore pay and allowances when it finds that an error or injustice caused financial loss. Common situations include:

Wrongful Discharge: If your separation was unjust and the BCMR upgrades it, you may be entitled to pay for the period you should have remained on active duty.

Improper Demotion: If you were unlawfully reduced in rank, the BCMR can restore both your grade and the pay you lost.

How the Process Works
Step 1: File a Petition (DD Form 149)
Petition the BCMR for correction of your record. Clearly state the injustice or error.
Step 2: Provide Proof of Financial Loss
Backpay isn’t automatic. You need evidence—leave and earnings statements, pay stubs, orders, and calculations showing what you should have received.
Step 3: BCMR Reviews the Case
The board weighs whether an error or injustice caused you to lose pay or benefits.
Step 4: Defense Finance and Accounting Service (DFAS) Executes Payment
If approved, DFAS calculates and issues backpay. This can include base pay, allowances, and even retirement adjustments.

Scenario 1 – Wrongful Separation
Corporal James was separated under Other Than Honorable conditions in 2018. In 2022, the BCMR upgraded his discharge. He received four years of backpay plus retroactive VA eligibility.
