At National Security Law Firm, we’ve long advocated for the rights of individuals seeking a clean slate through expungement in New Jersey. One of the biggest barriers to true relief has been the unreasonable delays in processing expungement orders by the New Jersey State Police (NJSP)—delays that have left tens of thousands of people in legal and professional limbo.

For years, individuals with court-approved expungements continued to be flagged in background checks, their lives stalled due to an overwhelmed and underperforming agency. But after significant legal pressure, real change is finally underway.

⚖️ A Turning Point: NJSP Settlement Reached in Class Action Lawsuit

In October 2023, the New Jersey Office of the Public Defender (OPD) filed a class action lawsuit against the NJSP for their failure to process court-ordered expungements in a timely manner. At the time, over 50,000 expungements were backlogged, with some individuals waiting more than a year for their records to be cleared—even after receiving expungement approval from a judge.

This inaction had serious consequences:

  • Qualified applicants lost out on jobs

  • Individuals were denied housing or licenses

  • Background checks continued to report records that had already been expunged by the courts

Despite receiving $15 million in state funding in 2019 to address the backlog, the NJSP had fallen dangerously behind, violating not only court orders but the very spirit of New Jersey’s progressive expungement laws.

📢 March 2025: NJSP Agrees to 120-Day Expungement Deadline

After sustained legal pressure, a breakthrough settlement was reached in March 2025 between the OPD and NJSP. Under this agreement:

  • All expungement orders must be fully processed within 120 days of receipt

  • The NJSP will use best efforts to complete processing in 90 days

  • Full compliance is expected by June 1, 2025

This resolution means that individuals who file for expungement today can expect their record to be removed from NJSP background check systems within four months of court approval.

⚡ April 2025: New Law Alert: You May Be Able to Speed Up Your Expungement

Waiting months—or even a year—for your record to be cleared? That used to be the norm in New Jersey. But as of April 2025, a new statewide legal settlement allows you to formally request faster processing by the New Jersey State Police—if you act early.

✅ But here’s the catch: you must request expedited handling at the time you file.

At National Security Law Firm, we now offer a flat-fee Expedited NJSP Processing Service for qualifying cases. It’s the fastest legal path available to clearing your record in New Jersey—especially if you’re applying for a job, professional license, or background-sensitive opportunity.

⏱️ What This Means for You

Thanks to this legal victory, we now estimate that expungements filed today will take approximately 6 to 12 months total from initial filing to final record removal.

➤ Filing to Court Approval: ~3 to 4 months

➤ NJSP Record Removal: ~3 to 4 months or even quicker if you are granted an expedited expungement

Total estimated time: 6–8 months (or faster if expedited)

If your expungement petition is currently pending, you are automatically included in the class action lawsuit. You do not need to take any further action to be represented in this legal effort.

A Client Story: “My Record Was Supposed to Be Gone, But It Wasn’t”

John (not his real name) came to us after another lawyer got him an expungement order. Months later, his arrest was still showing up on background checks. He lost two job offers. He was furious — and felt cheated.

This happens all the time. Why? Because most firms stop when the judge signs your order. They never follow up with government agencies. They never notify private background check companies. And the client is left paying the price.

How NSLF Fixed It

When John hired us, we immediately:

  • Verified government databases to make sure the order was actually processed (it wasn’t).

  • Notified private background check companies using our proprietary system.

  • Confirmed removal from every database where his record was still appearing.

  • Put him under our lifetime cleanup guarantee — if his record ever resurfaces, we’ll fight to remove it for free.

John is now working in a career he thought was out of reach.

Clear, Flat Pricing
